MEMBERSHIP AGREEMENT

1. PARTIES

This agreement has entered into force upon mutual acceptance by electronic approval between the website operating under the domain name www.chompo.net, Chompo Pet Food hereinafter briefly referred to as “CHOMPO”, and the person who becomes a member of the www.chompo.net portal, hereinafter briefly referred to as the “MEMBER”.

2. DEFINITIONS

  • “MEMBER”: Real and/or legal persons who become members of CHOMPO and benefit from the services offered on the website within the terms specified in this agreement.
  • “VISITOR”: Any real or legal person who accesses CHOMPO online, browses the website and performs transactions without logging in as a member.

3. SUBJECT AND SCOPE OF THE AGREEMENT

The subject of this agreement is to determine the services offered by CHOMPO, the terms of benefiting from these services, and the rights and obligations of the parties. The scope of the agreement includes all explanations, warnings and declarations regarding use, membership and services within CHOMPO. By accepting these provisions, the MEMBER also accepts all statements made by CHOMPO.

4. MEMBERSHIP AND TERMS OF USE

CHOMPO may unilaterally terminate this agreement, terminate the membership or temporarily suspend it without providing any reason, without notification and without paying any compensation.

These decisions are entirely at CHOMPO’s discretion and may be based on membership terms, website rules or situations that pose a risk in terms of information security.

5. RIGHTS AND OBLIGATIONS

5.1. RIGHTS AND OBLIGATIONS OF THE MEMBER

  • The MEMBER agrees to act in accordance with the agreement, declarations and legislation while benefiting from CHOMPO services.
  • Confidential/private/commercial information belonging to the member may be disclosed when requested by official authorities. In this case, no compensation may be claimed.
  • The MEMBER is responsible for the security of their username and password. The MEMBER is personally responsible for any damages that may arise due to sharing them with others or due to access by third parties.
  • Listings on CHOMPO are free of charge. The MEMBER cannot request any fee in return for a listing.
  • The MEMBER is responsible for any damages that may arise from their suggestions, information or actions.
  • The MEMBER cannot transfer their rights under the agreement to third parties.
  • CHOMPO’s database and contents cannot be copied, distributed or used on other platforms without permission.
  • CHOMPO cannot be held responsible for damages suffered by third parties due to the MEMBER’s unlawful activities.

5.2. RIGHTS AND OBLIGATIONS OF CHOMPO

  • CHOMPO has the right to suspend or terminate its services and infrastructure at any time.
  • CHOMPO may modify, delete or restrict access to content uploaded by members.
  • CHOMPO may remove content that is contrary to the operation of the website and terminate membership.
  • CHOMPO operates as a “Hosting Provider” within the scope of Law No. 5651.

6. OTHER PROVISIONS

6.1. Amendments to the Agreement
CHOMPO has the right to unilaterally amend the agreement. Amendments become effective on the date they are published on the website.

6.2. Force Majeure
CHOMPO cannot be held responsible for failure to fulfill obligations due to force majeure events such as natural disasters, war, strikes, communication problems, internet failures or power outages.

6.3. Applicable Law and Jurisdiction
Turkish Law shall apply to the implementation of the agreement. Istanbul Courts and Enforcement Offices shall have jurisdiction in the resolution of disputes.

6.4. Validity of CHOMPO Records
The MEMBER accepts that CHOMPO’s system records shall constitute valid evidence.

6.5. Entry into Force
This agreement enters into force upon mutual acceptance by the MEMBER’s electronic approval.
